Facts

Defendant Keith Presley is before the Court for resentencing on a remand from the Court of Appeals for the Sixth Circuit. See United States v. Davis, 430 F.3d 345 (6th Cir. 2005). Presley is sentenced to 120 months on Count 1, forty-eight (48) months on Count 2, and 120 months on Count 12. The sentences are to run concurrently and are to be followed by five (5) years of supervised release under the standard terms and conditions of this District.
