Title: UNITED STATES OF AMERICA, Plaintiff, v. SAMUEL MULLET, SR., et al.…
Court: UNITED STATES DISTRICT COURT NORTHERN DISTRICT OF OHIO EASTERN DIVISION
Case Number: 5:11 CR 594
Date: Dec 6, 2012
Fact:
Defendant Samuel Mullet, Sr., along with several co-defendants, was convicted by a jury on seven counts, including four counts related to religiously motivated beard- and hair-cutting attacks. Subsequently, Mullet, Sr., filed a motion pursuant to Rule 29 of the Federal Rules of Criminal Procedure, seeking a judgment of acquittal or, alternatively, a new trial under Rule 33. His co-defendants joined in this motion.
Issue:
Whether the evidence presented at trial was sufficient to sustain the convictions, whether newly discovered evidence warranted a new trial, and whether the admission of certain pieces of evidence constituted a miscarriage of justice.
Conclusion
For the foregoing reasons, Defendant’s motion (Doc. # 264) is denied as to both Samuel Mullet, Sr. and the co-defendants who have joined in the motion.
